Terms and Conditions

1. Acceptance

Using Telemini as a Creator, or using any Mini App built on Telemini as a Visitor, means you agree to these Terms and Conditions. If you do not agree, do not use the Platform or any associated Mini Apps.

2. Definitions

• Platform: Telemini, operated by Digital Dhandha.
• Creator: A user who builds, configures, and operates a Mini App on the Platform.
• Mini App: The Telegram-based application a Creator builds using Telemini.
• Visitor / End User: Anyone who interacts with or chats with a Mini App via Telegram.
• Plan: A Creator-defined package (duration, message limit, photo limit, video limit, and price in Telegram Stars) that a Visitor purchases to use a Mini App.
• Companion: The AI-driven persona a Creator configures on the Platform.

3. Eligibility

You must be 18 years of age or older to use Telemini in any capacity. By using the service you represent and warrant that you meet this requirement. We reserve the right to request age verification and will terminate, without notice, any account we have reason to believe belongs to a minor.

4. Nature of the Service

Telemini is a platform for building Telegram Mini Apps. Companions are AI-generated personas — not real people — and their responses are produced by a third-party AI model. Telemini does not write, curate, or verify any Companion's content. Creators alone are responsible for their Companion's profile, persona, and uploaded media.

5. Creator Responsibilities

• You are solely responsible for the Telegram bot token you provide and everything done through your connected bot.
• You are solely responsible for all content you upload or configure, and you warrant you own or have full rights to it, and that it does not depict any real, identifiable person without that person's explicit consent.
• You are solely responsible for the Plans and pricing you create and your relationship with your Mini App's Visitors.
• You agree to indemnify Digital Dhandha against any claim arising from your content or your Companion's configuration.

6. Prohibited Content and Conduct

You may not upload, configure, or distribute through the Platform:

• (a) Any content depicting or sexualizing minors, in any form. Zero tolerance. Violating accounts are permanently and immediately terminated without notice, and reported to NCMEC and/or law enforcement authorities as legally required.
• (b) Sexually explicit content, pornography, or content intended primarily for sexual gratification.
• (c) Graphic violence, gore, or content promoting self-harm or suicide.
• (d) Content promoting illegal drugs or controlled substances.
• (e) Hate speech, harassment, defamation, or discrimination based on race, religion, gender, nationality, disability, sexual orientation, or similar protected characteristics.
• (f) Impersonation of any real person without legal consent, including AI-generated ("deepfake") likenesses.
• (g) Content infringing anyone's intellectual property, trademark, copyright, or privacy rights.
• (h) Malware, spam, phishing, spyware, or fraudulent schemes.
• (i) Content promoting terrorism, extremism, or illegal weapons and illicit goods.
• (j) Anything otherwise illegal under applicable law, including Indian law and international regulations.

We use automated tools, and may use human review, to detect violations. We reserve the right, at our sole discretion, to remove content and permanently block any Creator or Visitor account without prior notice for violating this section or for suspected illegal activity.

7. AI Disclaimer

Companions run on third-party generative artificial intelligence. Responses may be inaccurate, offensive, nonsensical, or otherwise inappropriate, and do not reflect the views of Digital Dhandha or any Creator. We make no warranty as to the accuracy, reliability, or appropriateness of any AI-generated content and are not liable for any harm arising from reliance on it. Companions are not a substitute for professional medical, legal, financial, or mental health advice.

8. Plans & Telegram Stars Payments

• Each Creator defines their own Plan(s) for their Mini App. A Plan specifies a duration, a message limit, a photo limit, a video limit, and a price in Telegram Stars — all set solely by the Creator.
• Visitors purchase Plans directly with Telegram Stars. A Visitor may hold more than one active Plan; limits remaining from a previous Plan carry over and stack with a newly purchased Plan rather than being replaced.
• Digital Dhandha is not a party to the Plan terms a Creator offers and does not guarantee any specific Plan configuration, pricing, or value.
• Purchased Plans and any remaining limits are non-transferable, have no cash value outside the Platform, and are forfeited upon account termination.

9. Payments & Subscriptions

Creator subscriptions are billed through Apple's App Store or Google Play and are subject to those platforms' respective billing terms, including auto-renewal. A free trial is offered in place of a refund right — see our Refund Policy for details.

10. Intellectual Property

The Platform, its software, trademarks, and branding belong exclusively to Digital Dhandha. Creators retain ownership of original content they upload but grant us a worldwide, royalty-free license to host, process, and display it as needed to operate the Platform and their Mini App.

11. Third-Party Services

The Platform depends on third-party services including Telegram, Google, Apple, Cloudflare, and advertising networks such as Monetag. We are not responsible for their availability, performance, actions, or policies — including Telegram's platform rules, app store review decisions, or ad payouts.

12. Termination

We may suspend or terminate any account or Mini App at any time, with or without notice, for any Terms violation, suspected illegal activity, or at our sole discretion. Unused Plan limits, subscription time, and stored data may be forfeited without compensation upon termination.

13. Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE," with no warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, secure, or error-free operation.

14. Limitation of Liability

To the maximum extent permitted by applicable law, our total liability for any claim will not exceed the amount you paid us in the 3 months preceding the claim. In no event shall Digital Dhandha be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, revenue, or goodwill.

15. Indemnification

You agree to defend, indemnify, and hold harmless Digital Dhandha, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your content, or your breach of these Terms.

16. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Maharashtra, India.

17. Changes to Terms

We may update these Terms at any time; continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
